General conditions of access and use of the terra.org portal

1. The terra.org Portal. 

Through the Portal terra.org the Terra Foundation gives free access to a wide variety of services and content related to the environment available to internet users.

2. Conditions of Access and Use of the Portal. 

Access to the Portal is conditional on the acceptance of all these General Conditions. These conditions, in their version published at the time the user accesses the Portal, will be understood to be expressly, fully and unreservedly accepted by the user, by the mere access and use of the Portal. That is why the user must read the General Conditions each time s/he intends to make use of the Portal.

The user expressly and fully accepts that access to and use of the Portal takes place under his or her sole and exclusive responsibility.

The user undertakes to use the Portal and the services it offers in accordance with the Law and these Conditions, as well as with morality and ethical values. And you agree to refrain from using the Portal for illicit purposes or effects that could be harmful to the interests or rights of third parties, or that in any way may damage, or prevent the normal use of the Portal by other users.

If the user does not accept these Conditions, they must refrain from accessing the Portal and making use of it.

3. Content. 

The Terra Foundation makes available to users a set of information, which, despite being prepared by professionals in the sector, and despite the care and diligence put into its preparation may contain inaccuracies or errors, or not be updated on the date of access to the user. In this sense, the Fundación Terra excludes any liability for damages of any kind derived from the lack of veracity, accuracy, completeness and / or timeliness of the contents that are part of the portal.

The Terra Foundation reserves the right to change, at any time, without prior notice and at its discretion, both the configuration of the Portal, as well as the services and contents provided; as well as the right to suspend, limit, eliminate or prevent access to them temporarily or permanently. Likewise, it reserves the right to modify the transmission, tracking or other technical means or services used for access or use of the Portal. The Fundación Terra excludes any liability for damages of any kind that may be due to the lack of availability or continuity of the operation of the Portal and the services, and the expectations that users may have made about the usefulness of the Portal.

To obtain the contents, the user must only use the means or procedures that in each case are indicated or that are made available for these purposes; or in general, those usually used on the Internet provided that they do not involve any type of risk for the proper functioning of the Portal.

The user is obliged to use the contents correctly and lawfully and in accordance with the provisions of the Laws on Intellectual and Industrial Property.

4. Services provided by Third Parties. 

The Terra Foundation offers on its Portal as a service, also free of charge, the promotion of certain ecological products or services that are designed, manufactured and / or marketed by companies or groups or professionals, and that the user can acquire in the virtual store. In this service, the Terra Foundation makes available to the user a product purchase service, which will be governed solely and exclusively by the rules of contracting of the companies or professionals responsible for said service. The role of the Terra Foundation in this service is that of organizer of the portal, understanding by organization the grouping of the products and their availability in the Portal. Therefore, all transactions must occur outside the scope of the Portal, not being the Terra Foundation, in any case responsible for the content, execution or result thereof. The Terra Foundation only generically promotes these products and services, but in no case endorses the quality and / or proper functioning of them, nor is it responsible for it.

5. Intellectual and Industrial Property. 

The entirety of the contents of this Portal, as well as the images, trademarks, logos, audio and video files, buttons, software files, colour combinations, as well as the structure, selection, arrangement and presentation of its contents is protected by Spanish and international laws on intellectual and industrial property. Copyright is held by Terra Foundation.

The total or partial reproduction of the contents of this Portal without the express permission of Fundación Terra is totally prohibited. The content of this portal is also considered a computer program, so all the Spanish and European Community regulations in force in the matter are applicable.

Links to other sites: links to internet websites do not represent any relationship between Fundación Terra and the individuals or companies that own said web sites, so Fundación Terra is not responsible for the contents of said websites, nor does it necessarily share the opinions expressed in them.

6. Limitation of Liability

a) Terra Foundation does not guarantee that its Portal is operational at all times, nor that the contents are updated and reliable in their entirety. In this sense, it is not responsible for direct or indirect damages of any kind that may arise from the interruption of the service by the Portal as well as its continuity or the modifications that are operated in it. The user exonerates the Terra Foundation from any responsibility in relation to the reliability, usefulness or false expectation that the Portal could produce.

b) This Portal has the technology (software and hardware) necessary, today, for access and/or use of it, however, the Terra Foundation does not guarantee the possible existence of viruses or other harmful elements, introduced by any means and by any third party, that may cause alterations in computer systems, electronic documents or files of the user. And it is not responsible for direct or indirect damages or losses derived from the use of the Portal, including damage to computer systems, electronic documents, or files of the user of any kind, whether they are due to the presence of viruses or other harmful elements or if they are due to any other cause.

c) The Terra Foundation is not responsible for the services provided by third parties through the Portal, so it excludes itself from any liability for damages of any kind that may be due to these services. The role of the Terra Foundation in these services is that of organizer of the portal, understanding by organization the grouping of the products and their availability on the Portal.

7. Links.

The users or holders who intend to create a hypertext link (hereinafter link) to the Portal must ensure and commit themselves to the rules established by the Terra Foundation on links on the network. These rules are basically focused on: 

  • a) Do not establish links to pages or subpages other than the home page except when the specificity of the subject requires it.
  • b) Do not associate the link with incorrect statements that may mislead, are contrary to the Law or ethics.
  • c) Do not include any trademark or sign susceptible to protection other than the URL address of the Portal.
  • d) Do not establish links with pages that contain content or propaganda of a sexist, racist, xenophobic, violent, pornographic nature, nor any apology of terrorism or attack on human rights, or content that in any way invites uncivil or violent attitudes or manifestations, and in general may harm in any way the good name of the Terra Foundation, the portal terra.org, or its sponsors.


8. Data Protection.

Only the personal data that the user has voluntarily provided when registering for any of the services that the Portal can offer will be stored. The data provided by the user of the network will be treated in accordance with the data protection policy of the entity.


9. Applicable Law.

These General Conditions shall be interpreted and governed in accordance with Spanish law.
